He is recognized in "Best Lawyers in America." As a Diplomat in the National College of Advocacy, Mark has lectured in 30 states, Canada and Mexico on issues of professional malpractice, nursing home negligence and trial advocacy. He is the author of the textbook Litigating Spinal Cord Injuries: Law, Medicine and Economics, and coauthor of Thompson-West’s, Deposition Notebook. Mark has served as lead counsel in wrongful death and catastrophic injury cases involving malpractice, construction injuries, nursing home neglect, interstate trucking accidents, and products liability. With a major focus on the representation of victims of nursing home neglect throughout the United States, he was elected chair of the National Nursing Home Litigation Group for the American Association for Justice . Smith is active in the Minnesota Association for Justice (MNAJ, formerly known as the Minnesota Trial Lawyers Association), having served on it Board of Directors (1994-2004) and its Executive Committee. Joel currently serves as the Chairperson of MNAJ’s Nursing Home Litigation Committee. He is also active in the Minnesota State Bar Association (currently serving on its Governing Council for the Elder Law Section and as the Co-Chairperson for the Vulnerable Adults Committee). Joel is a Sustaining member of the American Association for Justice (AAJ, formerly known as the Association of Trial Lawyers of America) and is actively involved in AAJ”s Nursing Home Litigation Group. He also serves on the Board of Directors for the Elder Care Rights Alliance (a Minnesota non-profit organization that advocates for the rights and safety of the elderly) and is a Sustaining member of the Minnesota Senior Federation. Joel has been recognized as a “Super Lawyer” by Law & Politics magazine since 2001. He is a co-author of Thompson-West Publication’s Tort Litigation chapter on Nursing Home Litigation. Kara is admitted to practice in State of Minnesota and United States District Court for the District of Minnesota. Kara is a member of the Minnesota Association of Justice (MNAJ, formerly known as the Minnesota Trial Lawyers Association) and is a member of MNAJ's Nursing Home Litigation Committee. She is a member of the American Association of Justice (AAJ, formerly known at the Association of Trial Lawyers of America) and of the Minnesota State Bar Association. She received her J.D. from Hamline University School of Law (cum laude). While in law school, Kara was a Presidential Scholar (2005-2008) and member of the Dean's Honor Roll, an Associate of the Hamline Law Review (2006-2007), and received the CALI Awards of Excellence in Legal Research and Writing, Mediation, and Native American Law Seminar. Kara’s Special Area of Study was Alternative Dispute Resolution. Kara received her B.A. in American Indian Studies from the University of Minnesota Twin Cities in 1998 (Dean's Honor Roll). Kara will speak to the national Nursing Home Litigation Group at an upcoming conference for the American Association for Justice. The conference, "Litigating Nursing Cases," will take place in Chicago on October 17th and 18th. Kara will be speaking on the subject of "Electronic Medical Research." Also, Kara and Mark Kosieradzki co-authored an article, "Keeping Discovery Civil," which was published in a recent issue of Trial magazine. Their article discusses common obstructive tactics frequently encountered in law suits. Kara and Mark offer practice tips to fellow trial lawyers for dealing with these improper tactics, including involving the judge when necessary, to make sure relevant information is not hidden by the opposing party. |
